ALTA/ACSM Land Title Surveys

 

Purpose - The purpose of this page is to define the client obligations in the process of requesting an ALTA/ACSM Land Title Survey and to address the survey certification and payment terms before the project enters the research phase. The process defined by this page pertains to the 2011 Minimum Standard Detail Requirements For ALTA/ACSM Land Title Surveys, effective February 23, 2011.

Client requirements - As specified in Section 2 of the Requirements, the client shall request the survey and provide written authorization to proceed from the person or entity responsible for paying for the survey. The standard policy of Ramsey Surveying, Inc. is to provide a Contract For Surveying Services to serve as the written authorization document. As specified in Section 4 of the Requirements, the client will also be responsible for providing the following documentation to the surveyor prior to an accurate cost analysis by Ramsey Surveying, Inc.:

The most recent title commitment, the current record description of the parent parcel(s), the current record description(s) of the adjoiners, any record easements, if possible all documents required to ascertain the junior/senior relationship, any other documents affecting the property being surveyed, name of client, name of lender, name of title company, names of any others for survey to be certified to and a completed "Table A" (download 2011 Minimum Standard Detail Requirements For ALTA/ACSM Land Title Surveys and print included Table A) with optional items to be included with the survey, signed and dated. All documents of record must include the recording information clearly legible on the document.

Survey Certification - As specified in Section 7 of the Requirements, the survey shall bear ONLY the certification provided in said Requirements. No additional certifications will be added to the survey under any circumstances. The 2011 Requirements were jointly established by the American Land Title Association (ALTA) and the National Society of Professional Surveyors (NSPS) in order to meet such needs that clients, insurers, insureds and lenders are entitled to rely on surveyors to conduct surveys and prepare associated plats or maps that are of a professional quality and appropriately uniform, complete and accurate, therefore making third party certifications unnecessary.

Payment Terms - It is the standard policy of Ramsey Surveying, Inc. to receive payment in full before releasing the survey data, regardless of closing arrangements. In some cases, a retainer fee may also be required.

Summary - It is essential for the client to understand the complexity of the ALTA/ACSM Land Title Survey process and how it effects both the client requesting the survey and the surveyor. Ramsey Surveying, Inc. will prepare all ALTA/ACSM Land Title Surveys to meet the proposed 2011 Requirements, unless the client specifically requests otherwise, until the propsed Requirements become effective. The cost of the project will be based on completing an accurate and thorough survey as specified by the Requirements and according to the availability of documents provided to the surveyor.
